Policies and Rental Agreement

TERMS AND CONDITIONS
Payment Terms: Please note that your reservation (for the dates outlined above) is being held for a period not to exceed 24 hours. Your reservation will not be confirmed until the 50% deposit has been received by Heath INS Properties LLC. By submitting your deposit, you have accepted the terms in this agreement. The remaining balance must be paid in full 30 days prior to arrival. If the reservation is made within 30 days of arrival, the full balance is due upon making the reservation. Accepted forms of payment include Visa, MasterCard, American Express or check/money order made payable to Daniel D Heath Trust#2011. A $35.00 charge shall be applied to all returned checks.
Cancellations: Cancellations or changes are non-refundable. EXCEPTION: At our discretion, a refund of your payment will be given if we are able to fill your canceled dates with another guest.
Security Deposit: A $1,000.00 security deposit shall be included on the final payment and held by Heath INS Properties LLC for the duration of the stay. Upon check-out, and after a walk-through of the property by the owner or manager and cleaning staff, a full refund of the security deposit shall be granted , less any amounts needed to repair or replace damaged or missing items from the property or to conduct additional cleaning (i.e., beyond three hours, professional carpet cleaning, etc.) Guest agrees to accept responsibility for all damage to or loss on the property during the stay. Any or all amounts of the security deposit shall be refunded within 21 days of checkout.
Check in: Check in shall be anytime on the day of arrival after 4:00 p.m.
Check out: Check out shall be anytime on the day of departure before 10:00 a.m.
Early Check-ins and /or Late Check-outs without written authorization of owner or manager are subject to forfeiture of the security deposit. Such authorization can only be confirmed 2 weeks prior to arrival/departure date.
Early Check-in starting at 8am: $300
Late Check-out ending at 8pm: $300
Pets: While we understand that often pets are part of the family, for the comfort of all our guests we have a STRICT NO PET POLICY and absolutely no pets may be kept in the home or on the property at any time. Guests acknowledge that an immediate termination of the tenancy and forfeiture of the security deposit may occur upon noncompliance with this policy. Guests also acknowledge that costs in excess of the security deposit may be incurred at the owner’s discretion.
Caretaker on premises: Guest is aware that property caretaker, manager or owner may be on the property grounds at any time to inspect the property as well as to make necessary repairs, alterations, improvements or in case of an emergency. Guest is aware that yard maintenance occurs regularly and service technicians may also be on property grounds at any time.
Homeowner’s Association: Please note the Homeowner’s Association does not permit street parking. No trailers or RV’s may be parked at the property, and no vehicle repairs are allowed. Garage doors must be kept down.
Beach: The beach area is public land. Please do not leave anything in the beach area unsupervised. (Examples: chairs, tables, coolers). No fires are permitted on the beach.
Housecleaning: Prior to arrival, the home is professionally cleaned and provided with fresh linens. This property is kept as a SMOKE-FREE environment. Smoking within the home will result in immediate forfeiture of the security deposit, and may result in additional fees at the owner’s or manager’s discretion.
Utilities: Thermostats must not be tampered with or reset, and must be turned off when any windows or doors are open. Excessive and/or reckless use of the home’s utilities is subject to additional charges at owner or manager’s discretion. DISH Network programming is also provided. Any pay-per-view programming ordered will be charged to the guest.
Upon Check-out, please complete the following checklist so as not to incur additional charges (damages or additional cleaning costs):
1. Load and run the dishwasher, and clean and put away all other dishes not in the dishwasher.
2. If used, clean both inside and outside of the BBQ grill.
3. Return all indoor and outdoor furniture to its original place.
4. Turn off all lights.
5. Check all beds, comforters, blankets, furniture, carpets, rugs, etc. for any stains that may have occured during your stay, and please notify us so we may remedy prior to the next arrival.
6. Take out all trash and recyclables to appropriate bins.
7. Close and lock all doors and windows and place keys, garage door or gate openers on the kitchen counter.
Other Provisions: Guest agrees that all children under the age of 18 must be supervised at all times for the duration of this Agreement. Guest agrees that conduct of any persons on the property shall not be unlawful, disorderly, nor will interfere with the quiet use and enjoyment of other residents in the community. Guest agrees that neither they, nor anyone on the property shall engage in any unlawful or prohibited activities in or around the property, and agrees not to use the property for the manufacture, sale or distribution of any goods or services whatsoever. Owner or manager reserves the right to terminate this reservation, without refund, if any of the activities of guests do not comply with the aforementioned, or if the total number of guests exceeds the maximum number of occupants specified in this Agreement.
Liability Release, Indemnity and Hold Harmless (the “Release”)
Guest agrees to forever release, indemnify and hold Heath INS Properties LLC, its Shareholders, Directors, Agents and Assigns (collectively, “HEATH”) harmless from any and all liability for and agrees to indemnify HEATH against any and all claims, actions, damages, liabilities, causes of action, suits, judgments, losses and expenses, including costs and attorney’s fees incurred by HEATH (collectively, the “Claims”) arising out of or from or during Guest’s rental or use of W4066 Boaters Dream Drive, Mauston, Wisconsin (the “Property”) including but not limited to, those Claims that result from (a) Guest’s failure to fulfill any condition of the Vacation Rental
Agreement to which this Release is attached; (b) any damage, injury or loss of life happening to Guest, Guest’s invitees or licensees (collectively, the “Guest Parties”) in or about the Property, including but not limited to the house, the premises or Castle Rock Lake or any damage or loss of the personal property of the Guest Parties; (c) The Guest Parties’ failure to comply with any requirements imposed by any governmental authority; and (d) any judgment, lien or other encumbrance filed against HEATH or any of its Shareholders, Directors, Affiliates, Agents and Assigns as a result of the Guest Parties’ actions. Guest further agrees to forever release and
hold HEATH harmless from liability for any act of God.
*Oct 2021 Addition:
On the rare occasion, due to ownership change, the property being removed from rental use, or a need for extensive repairs or maintenance, the Property may not be available for rental on the dates of a guest's reservation. In this unlikely event, Heath INS Properties LLC reserves the right to cancel the reservation. The guest will then receive a complete refund of their reservation payment.
